Six Figure Pay-Out for Bereaved Family – 29th March 2007
The trust responsible for Bath’s Royal United Hospital has paid a six figure settlement to the family of Daryl Eyles, a 37 year leukaemia patient. Mr Eyles was on the road to a full recovery following a programme of chemotherapy, when he contracted Legionnaire’s Disease from a poorly maintained shower and later died.
The hospital was condemned after an HSE investigation discovered a series of fundamental failings. The Magistrate Dr Jennifer Gunning commented that: "Guidance was available for more than 10 years, but this was blatantly not followed (by the hospital)”, she also noted that her own sentencing powers were insufficient for such a serious incident.
Andrea Eyles commented: “He was then struck down by Legionnaires' disease due to the woefully poor levels of maintenance and management. They've done wrong - they know they're in the wrong. I hope it never happens to anyone else." http://news.bbc.co.uk/1/hi/england/somerset/6507633.stm
